Brown & Curry represent family in lawsuit filed against Wellington, Kansas, school district for improper use of force on disabled student

Kansas City, Mo. – September 9, 2019– Brown & Curry is representing a family in a new lawsuit filed September 5 against USD 353 in Wellington, Kansas.The lawsuit alleges that the school district failed to supervise paraeducators who had been using forcible restraints on a blind student who used a wheelchair at a basketball game earlier this year. The lawsuit alleges that USD 353 personnel knew that a teacher had previously been pouring cold water on the student’s genitalia and had supervised use of martial-arts style pressure points on the student to control his behavior.The family asserts federal Section 1983 causes of action against the involved USD 353 personnel as well as negligent supervision against the school district for failing to properly train and monitor their conduct.The case is pending in the United States District Court of Kansas.
